About these terms

These terms apply to purchases from Tírnan Confectionery Limited, Mallow Road, Cork. They cover retail purchases through our website and, where stated, trade supply and contract-packing services. Contact us at sales@tirnanconfectionery.ie or +353 (0)21 202 1332.

Retail and trade customers

A retail customer buys as a consumer for purposes mainly outside their trade or profession. A trade customer buys for business, resale or professional purposes. Consumer rights provided by Irish law are not limited by these terms. Separate quotations, credit terms or written agreements agreed with a trade customer also form part of the contract and take priority where they expressly differ from these website terms.

Products and availability

We take reasonable care to describe and display products accurately. Packaging, colours, assortments and product details may change, and images are illustrative. All products are subject to availability. We may correct an obvious error, withdraw a product, limit quantities or cancel and refund an order where stock is unavailable or the price or description was clearly incorrect.

Prices and payment

Retail prices shown to consumers include VAT unless clearly stated otherwise. Trade quotations and trade prices may be stated exclusive of VAT, with VAT added at the applicable rate. Delivery charges and the final order total are shown before an online order is placed.

Online payment is handled by the payment methods offered at checkout. Trade orders are pro forma unless we have approved credit terms in writing. Credit facilities are discretionary and may be changed, suspended or withdrawn. We reserve all statutory rights relating to late commercial payments.

Orders and acceptance

Placing an order is an offer to buy. An automated acknowledgement confirms receipt but does not by itself mean that the order has been accepted. Acceptance takes place when we confirm dispatch, begin an expressly agreed bespoke service, or otherwise confirm acceptance in writing. We may contact you if information is incomplete or further checks are needed.

Delivery

Delivery estimates are given in good faith but are not guaranteed unless agreed in writing. Please provide a complete and accurate delivery address and inspect the order promptly on arrival. Keep the packaging and contact us as soon as possible if anything is missing, damaged or incorrect. Current charges and thresholds are set out on our Delivery Information page.

Consumer cancellation and returns

Consumers who buy online will generally have 14 days from receipt of goods to tell us they wish to cancel, followed by a further 14 days to return the goods. Legal exceptions can apply, including to goods made to a consumer’s specifications or clearly personalised, goods liable to deteriorate or expire rapidly, and sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed.

Please contact us before returning an item. Goods should be kept in suitable condition and packaged securely. Return costs are the consumer’s responsibility unless the goods are faulty, damaged or incorrect, or we agree otherwise. Refunds are made using the original payment method, subject to applicable law. See our Returns Policy for the practical process.

Faulty, damaged or incorrect goods

Your statutory rights are unaffected. If an item is faulty, damaged, unsafe or not as described, contact us promptly with the order number and, where useful, photographs. We will assess the issue and provide the remedy required by law.

Trade title, risk and inspection

For trade sales, risk passes on delivery unless otherwise agreed. Ownership remains with Tírnan Confectionery Limited until all sums due for the relevant goods have been paid in full. Until ownership passes, the customer must store the goods so they remain identifiable, properly protected and insured, and must not create a charge over them. Trade customers must inspect deliveries promptly and notify shortages, visible damage or discrepancies without undue delay.

Food products, allergens and storage

Ingredients, allergens, nutritional information, storage directions and best-before information supplied with the product should always be checked before use or resale, particularly because manufacturers may change formulations or packaging. Products must be stored, handled and rotated appropriately. Customers are responsible for checking that a product is suitable for their needs and those of the intended consumer.

Contract packing and private label

Contract-packing work is based on the approved quotation, specification, artwork, quantities, tolerances and timetable. The customer is responsible for the accuracy and legality of instructions, claims, artwork, barcodes and information it supplies, and for having the rights to use supplied intellectual property. Customer-supplied materials must be suitable, compliant and delivered on time.

Reasonable production tolerances may apply to finished quantities, weights, colour, placement and packaging materials. Bespoke materials, committed stock and work already performed may be chargeable if a project is changed, postponed or cancelled. Each party must cooperate with reasonable traceability, withdrawal or recall requirements.

Intellectual property and website use

The website, Tírnan branding, layout, photographs, graphics and original content are protected by intellectual-property rights. You may use the website for lawful personal or business purchasing only and must not copy, scrape, reproduce or commercially exploit its content without permission.

Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or a consumer’s statutory rights. Subject to that, we are not responsible for loss caused by misuse, unsuitable storage, failure to follow product information, inaccurate customer-supplied material, or events outside our reasonable control. For trade customers, we are not liable for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings to the extent permitted by law.

Events outside our control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including transport disruption, supplier failure, severe weather, industrial action, utility or network failure, government action, or other force-majeure events. We will take reasonable steps to reduce the effect and keep affected customers informed.

Suspension and cancellation

We may suspend supply or cancel an unfulfilled trade order where payment is overdue, creditworthiness materially changes, information is misleading, or continuing would create a legal, safety or operational risk. Bespoke and contract-packing cancellations may be subject to charges for work completed, committed stock and non-cancellable materials.

Governing law

These terms are governed by Irish law. Consumers retain any mandatory protections and jurisdiction rights available to them. Trade disputes are subject to the courts of Ireland unless otherwise agreed in writing.
